Contractor Damage Resolution – October 18, 2011


Resolution of the Board at the 10/18/2011 meeting.

An issue was discussed in pre-board meeting: Katie’s foundation damage caused by Thomas Construction during roof repair on Baltimore.  Board and Homeowner were not happy with THOMAS CONSTRUCTION’s repair of it. Proper protocol, to call Leeann first, was not followed. Repairs were done prior to the Board doing a proper evaluation. Now Katie is not sure the structure has been repaired correctly.  Gary is going to address this by sending a letter to THOMAS CONSTRUCTION, copy to Katie, and keeping the Board in the loop as to, in the future, what his actual course of process should be. Also it will state that, should there be any type of malfunction with this repair, THOMAS CONSTRUCTION will be responsible to have it corrected. This is going into the minutes for the record.  There must be communication among all parties, along with an opportunity to look at the situation.  If Homeowner or Board is not satisfied there has to be opportunity to say No, either don’t do it or do it at your own risk. Basically THOMAS CONSTRUCTION has done the repair at his own risk and he will be held responsible if something is wrong.  GERRY EAGAN moves to authorize Gary to send a letter to Thomas Construction and ask him not to repair anything unless authorized by the Board and the property manager, consistent with the directions of the Board;  BOB TUREK seconds.   Passed.
