Resolution of the Board at the 2/28/2012 meeting.

Gary: Issues of responsibility between owner and HOA have been ongoing, because action on various questions has varied from Board to Board.  I went through the Prospectus and By-Laws with a pretty in-depth review.  A good part of it is clear; some of it is not clear.  I gave the Board an opinion letter as to what I thought, on balance, the responsibilities were.  The Board can vote to adopt this letter as policy so that there will be consistency going forward regarding what the HOA will pay for and what the owner will pay for.  We have not changed the Prospectus.  It is a question of interpretation.  This letter is an attempt to resolve some discrepancies and ambiguities. Sue: The Board will pass a motion tonight to accept these recommendations as policy.  The opinion letter will appear on the website and is included here so homeowners may see the recommended clarifications. Nothing is changed, it is merely defined so we can go forward consistently. Maureen Carlo moves to accept and adopt the opinion letter as a resolution in determining responsibility of the HOA and individual unit owners in regard to repairs.  John Burdo seconds. Passed.
