Plantings on Common Area Resolution – December 6, 2016

Resolution of the LCV Board at the 12/6/2016 meeting.

In response to two complaints regarding bush pruning by homeowner on common area a proposal by Don Cosgro regarding tree or brush pruning on common area was presented.  A permission form similar to the one required for the building and landscape committee request was passed out to board members.  This will protect members that trim trees and bushes on the common area from possible enforcement action and is a technical requirement of the declaration. 

A motion by Peter Hayden, second by Tom Maglienti to adopt the permission form as presented with the requirement it be posted on the website and kiosks before becoming effective,  passed 4-1 Patty Jaehn in the negative.   (See form below)

Per the LCV HOA Declaration:  ARTICLE VI, SECTION 1. COMMON AREA MAINTENANCE 
“….No planting or alternations may be made to the common area by an individual Owner, including the cutting or pruning of trees or shrubs in such Common Area (even if branches or roots overhang or enter upon an Owner’s Lot), except with the express written consent of the Board of Directors of the Association.”

Prior to commencing such request, you must understand that any LCV Common property damaged, altered or affected will be restored by you to its original state. You take full responsibility in repairing the area and you understand that if you fail to make the necessary repairs to the area, LCV HOA will make the necessary arrangements and repairs and such cost and expense incurred will be owed and payable by you to the HOA. By signing and accepting this approval you agree to these terms and may commence your work. It is your responsibility to acquire all necessary insurance and local permits required, and to abide all local code and zoning requirements.
